LEGAL TERMS OF SERVICE
Terms and Conditions
The terms governing access to Mothercare Infotech software services, subscriptions and customer workspaces.Effective and last updated: 23 September 2026
These Terms and Conditions form an agreement between MOTHERCARE INFOTECH (“Mothercare Infotech”, “we”, “us” or “our”) and the customer or authorised user (“you”). By registering, paying, starting a trial, signing in or using a service, you confirm that you have read and accepted these terms, our Privacy Policy and our Refund and Cancellation Policy.
1. Services and eligibility
We provide digital software and support services for accounting data conversion, TallyPrime integration, GST and income-tax compliance, reconciliation, banking automation, audit reporting and business analysis. You must be legally competent to contract in India and, when acting for a business, authorised to bind that business.
2. Account registration and Tally licence
You must provide accurate and current registration information. Each workspace operates with a valid registered Tally serial number. A Single User plan is intended for one system at a time with a valid Tally single-user licence. A Gold / Multi User plan supports multiple systems on the same local network using a valid Tally Gold licence. Access to individual tools may require administrator approval.
3. Customer responsibilities
- Keep login credentials confidential and notify us promptly of unauthorised use.
- Upload or process only information you are authorised to use.
- Review extracted, reconciled or generated records before posting, filing or relying on them.
- Maintain appropriate backups of source documents and accounting data.
- Do not misuse, probe, disrupt, reverse engineer, resell, share access outside the licensed scope, introduce malicious code or attempt to bypass security or permission controls.
4. Orders, prices and taxes
Current plan descriptions and prices are shown before checkout. Unless stated otherwise, prices are exclusive of GST and the payable total is displayed before payment. An order is accepted only after payment is verified and registration is successfully completed. We may correct obvious pricing or technical errors before activation and will offer cancellation or correction if an accepted order is affected.
5. Digital delivery and support
This is a digitally delivered service; there is no physical shipment. Access is normally provided through the registered online workspace after verified payment and activation. Support is available through the channels listed on the Contact Us page.
6. Third-party software and portals
Some workflows depend on third-party products or systems such as TallyPrime, government portals, banks, browsers, networks and authorised payment services. Those systems have separate terms and availability. We are not responsible for an outage, format change, rejection, licence issue or security control operated solely by a third party, but we will make reasonable efforts to keep supported integrations working.
7. Intellectual property
The website, software, source code, workflow design, documentation, branding, graphics and service content are owned by or licensed to Mothercare Infotech and are protected by applicable intellectual-property law. A valid subscription grants a limited, non-exclusive, non-transferable and revocable right to use the enabled services for the customer’s internal business purposes during the subscription period. No ownership is transferred.
You retain ownership of your source documents and business data. You grant us the limited rights necessary to host, process, convert, reconcile, test, support and otherwise perform the requested or consented services.
8. Suspension and termination
You may stop using the service or request cancellation under the Refund and Cancellation Policy. We may suspend or terminate access when a subscription expires, payment fails or is reversed, information is fraudulent, the account creates security or legal risk, these terms are materially breached, or continued service is prohibited by law. Where reasonably possible, we will provide notice and an opportunity to correct a remediable breach. On termination, the licence to use the service ends; provisions concerning payment, confidentiality, intellectual property, disclaimers, liability and governing law survive.
9. Disclaimer
The services assist with data processing and review but do not replace professional accounting, tax or legal advice. Automated extraction and reconciliation can require user correction. You remain responsible for validating records, backups, statutory filings, tax positions and Tally postings before final use.
10. Limitation of liability
To the maximum extent permitted by law, Mothercare Infotech is not liable for indirect, incidental, special, punitive or consequential loss, including loss of profit, business opportunity or data, arising from use of the service. Our aggregate liability for a claim relating to a paid service will not exceed the fees actually paid by the affected customer for that service during the twelve months immediately preceding the event giving rise to the claim. Nothing in these terms excludes liability that cannot lawfully be excluded or limits mandatory consumer rights.
11. Governing law and dispute jurisdiction
These terms are governed by the laws of India. Subject to any mandatory consumer forum or statutory remedy, courts having jurisdiction over our principal business address in Tiruppur, Tamil Nadu will have jurisdiction. The parties should first attempt good-faith resolution through the contact channels on this website.
12. Changes, severability and contact
We may update these terms for legal, security or service changes. Material changes will be notified on the website or through available account contact details. If one provision is held unenforceable, the remaining provisions continue. Questions may be sent to admin@mothercarecrm.com or through our published phone numbers.
